If you ride a moped, can you carry a passenger without a helmet?

In accordance with the provisions of the Road Traffic Act, the requirement to wear a protective helmet while riding applies to both the rider of a moped and any person being carried as a passenger. The law makes no exceptions to this rule for the passenger, and therefore carrying one without a helmet is strictly prohibited.
