Are you allowed to overtake the cyclist in this situation?

In the left rear-view mirror, a red car is clearly visible, which has moved into the adjacent lane and started the manoeuvre of overtaking your vehicle. According to Art. 24 para. 1 pt. 2 of the Road Traffic Act, before overtaking, the driver is obliged to ensure that the vehicle behind has not already started this manoeuvre. In this situation, overtaking the cyclist is prohibited, as it would force the vehicle overtaking you to brake sharply or change its course.
