If you ride a moped, can you transport a passenger who is intoxicated?

The provisions of the Road Traffic Act explicitly prohibit carrying an intoxicated person on a moped. A passenger under the influence of alcohol has impaired balance and motor coordination, and is therefore unable to maintain a safe position on the vehicle. This situation creates an extreme hazard to the safety of both the driver and the passenger.
